These Terms & Conditions (“Terms”) govern all purchases made through the website vivelaflex.com (“Website”), operated by Vive la Flex (“we,” “us,” “our”), based in the Netherlands. By placing an order through the Website, you (“Customer,” “you”) agree to these Terms. Please read them carefully before making a purchase.
1. Definitions
Agreement: any distance contract between Vive la Flex and the Customer for the purchase of Products through the Website.
Customer: the natural person who enters into an Agreement with Vive la Flex for personal, non-commercial purposes.
Product(s): the custom-printed t-shirts and any other goods offered for sale through the Website.
Act: a curated limited-edition collection (drop) of designs offered by Vive la Flex.
Business Day: Monday through Friday, excluding nationally recognized public holidays in the Netherlands.
Written/In Writing: includes communication by email.
2. Identity of the Seller

3. Applicability
3.1. These Terms apply to every offer, quotation, and Agreement between Vive la Flex and the Customer, insofar as the parties have not explicitly deviated from these Terms in writing.
3.2. Before the Agreement is concluded, these Terms are made available to the Customer. By placing an order, the Customer confirms having read and accepted these Terms.
3.3. Vive la Flex reserves the right to amend these Terms. The version of the Terms in effect at the time of placing an order applies to that order.
4. The Offer
4.1. All Products on the Website are described as accurately as possible. Descriptions include, where applicable: materials, color, size options, price (including VAT), and images.
4.2. Product images on the Website are a faithful representation of the Products offered. However, due to the nature of screens and printing processes, minor color variations between the displayed image and the delivered Product may occur. Such variations do not constitute a defect.
4.3. Each Act is a limited-edition collection. Vive la Flex reserves the right to discontinue any Product or Act at any time without prior notice.
4.4. Obvious errors or mistakes in the offer do not bind Vive la Flex.
5. The Agreement
5.1. The Agreement is concluded at the moment the Customer completes the checkout process and payment is confirmed by the payment provider.
5.2. Upon conclusion of the Agreement, Vive la Flex sends the Customer an order confirmation by email, including the order number, ordered Products, total amount paid, and shipping information.
5.3. Vive la Flex uses Stripe as its payment provider. By completing payment, the Customer also agrees to Stripe’s applicable terms of service.
6. Custom-Made Products and Exclusion of the Right of Withdrawal
6.1. All Products sold by Vive la Flex are custom-made. Each t-shirt is printed on demand using direct-to-garment (DTG) printing technology after the Customer places an order. Products are manufactured to the Customer’s specifications (selected design, color, and size combination) and are not prefabricated.
6.2. Pursuant to Article 6:230p sub c of the Dutch Civil Code (Burgerlijk Wetboek), implementing Article 16(c) of EU Directive 2011/83/EU on consumer rights, the 14-day right of withdrawal (herroepingsrecht/bedenktijd) does NOT apply to the Products sold by Vive la Flex, as they are goods manufactured according to the Customer’s specifications that are not prefabricated and are produced on the basis of an individual choice or decision by the Customer.
6.3. By placing an order, the Customer expressly acknowledges and agrees that: (a) the Product will be custom-printed specifically for their order; (b) production begins after payment is confirmed; (c) the right of withdrawal does not apply to custom-made products; (d) the order cannot be cancelled once payment is confirmed and production has started.
6.4. This exclusion is clearly communicated to the Customer prior to completing the purchase, in accordance with the information requirements under Article 6:230m of the Dutch Civil Code.
7. Prices and Payment
7.1. All prices listed on the Website are in euros (EUR) and include Dutch VAT (BTW) at the applicable rate (currently 21%).
7.2. Shipping costs are not included in the Product price and are displayed separately during checkout: Netherlands: EUR 4.95 | Belgium: EUR 5.95 | Orders with a subtotal of EUR 149.00 or more: free shipping.
7.3. Vive la Flex reserves the right to adjust prices at any time. Price changes do not affect orders that have already been confirmed.
7.4. Payment is processed at the time of checkout through Stripe. Accepted payment methods include iDEAL, Bancontact, credit cards (Visa, Mastercard), Apple Pay, and Google Pay. The available payment methods may vary and are displayed during checkout.
7.5. Promotional codes may be applied during checkout where applicable. Promotional codes are subject to their own terms and conditions, are non-transferable, and cannot be exchanged for cash.
8. Production and Delivery
8.1. All Products are printed on demand by our fulfillment partner in the Netherlands.
8.2. Estimated production time is 5 to 7 Business Days. After production, delivery within the Netherlands and Belgium typically takes 2 to 4 Business Days.
8.3. The total estimated time from order confirmation to delivery is 7 to 11 Business Days. These are estimates, not guaranteed delivery dates.
8.4. Delivery times during peak periods (holidays, product launches) may be longer. Vive la Flex will inform the Customer of significant delays when possible.
8.5. The risk of loss or damage to the Product passes to the Customer upon delivery.
8.6. If a delivery cannot be completed due to the Customer providing an incorrect or incomplete shipping address, any additional shipping costs for redelivery are at the Customer’s expense.
9. Conformity and Defects
9.1. Vive la Flex guarantees that the Products conform to the Agreement, the specifications stated in the offer, and reasonable expectations of quality and durability, in accordance with Articles 7:17 and 7:18 of the Dutch Civil Code.
9.2. Products are made from 100% organic ring-spun combed cotton (200 g/m²) and are DTG printed. Normal characteristics of the printing method and the natural properties of cotton do not constitute defects.
9.3. A Product is considered defective if: (a) the wrong design, color, or size was delivered; (b) there is a clear print defect; (c) the Product is damaged upon arrival.
10. Complaints and Returns for Defective Products
10.1. The Customer must inspect the Product promptly upon delivery.
10.2. Defects must be reported within 14 days of receipt by emailing hey@vivelaflex.com with the order number, a description of the defect, and photographs.
10.3. Vive la Flex will respond within 14 days of receipt.
10.4. If justified, Vive la Flex will send a replacement or issue a refund, including shipping costs.
10.5. Return shipping costs for defective Products are borne by Vive la Flex.
11. Warranty
11.1. All Products carry the statutory warranty as provided by Dutch law.
11.2. The warranty does not cover normal wear and tear, improper use, or alterations by the Customer.
12. Force Majeure
12.1. Vive la Flex is not liable for failure to perform due to force majeure as defined in Article 6:75 of the Dutch Civil Code.
12.2. Force majeure includes disruptions at the fulfillment partner, supplier failures, transport disruptions, natural disasters, pandemics, government measures, power failures, internet disruptions, and strikes.
12.3. If force majeure lasts longer than 30 days, either party may terminate the Agreement. Vive la Flex will refund amounts paid for undelivered Products.
13. Liability
13.1. Total liability is limited to the amount paid by the Customer for the Product(s) in question.
13.2. Vive la Flex is not liable for indirect damages, inaccurate Customer information, or minor color variations.
13.3. These limitations do not apply to intentional misconduct or gross negligence, or to mandatory liability under Dutch law.
14. Intellectual Property
14.1. All intellectual property rights relating to the Website are owned by or licensed to Vive la Flex.
14.2. The artwork featured on the Products has been sourced from the public domain. The selection, curation, and adaptation are the creative work of Vive la Flex.
14.3. Reproduction or commercial exploitation of Website content requires prior written permission.
14.4. Purchasing a Product grants personal, non-commercial use only.
15. Privacy and Personal Data
15.1. Vive la Flex processes personal data in accordance with the GDPR/AVG.

16. Newsletter and Marketing Communications
16.1–16.3. Newsletter subscription is voluntary. Each email contains an unsubscribe option.
17. Applicable Law and Disputes
17.1. Dutch law applies exclusively.
17.2. We aim to resolve disputes amicably. Contact: hey@vivelaflex.com.
17.3. Unresolved disputes go to the competent Dutch court.

18. Severability
18.1–18.2. Invalid provisions are replaced by the closest valid alternative; remaining provisions stay in effect.
